What Does the Grokster Decision Mean for Congress,
the Courts and the Marketplace?
Internet Caucus Panel to Feature Verrilli, Von Lohmann and Greenberg, plus remarks from Congressman Bob Goodlatte and the Honourable Arlene McCarthy, Member of the European Parliament
WHAT: The Internet Caucus Advisory Committee will assemble a panel of lead counsels involved in the Supreme Court MGM v. Grokster case to discuss the implications of the Court's decision. The educational panel luncheon, entitled "Interpreting Grokster: Protecting Copyright in the Age of Peer-to-Peer," will be held on Tuesday, July 19, 2005 in room HC-5 of the U.S. Capitol Building. The decision took a major step by finding against the respondents, Grokster and Streamcast, and establishing secondary liability for copyright infringement. The Supreme Court's decision adopted an active inducement standard, similar to one urged in the IEEE filing by Andrew Greenburg, which relied on patent law and preserved the Sony Betamax standard for technologies with lawful purposes. Join us on July 19 to see these key players in the copyright battle square off to debate the practical implications of the decision.
WHO: The fair and balanced panel will be moderated by Jonathan Krim, Staff Writer, Washington Post, and will feature: Don Verrilli of Jenner & Block, who successfully argued on behalf of the plaintiffs before the Court; Fred von Lohmann, senior staff attorney with the Electronic Frontier Foundation, who represented StreamCast Networks in the MGM v. Grokster case since the beginning and argued the case before the Ninth Circuit; and Andrew Greenberg of Carlton Fields who filed an amicus brief on behalf of the IEEE urging the Court to adopt the active inducement standard. The panel will be preceded by remarks from Congressman Bob Goodlatte, House Judiciary Committee, and the Honorable Arlene McCarthy, Member of the European Parliament.
