PATRIOT Act Provisions Scheduled to
Sunset at Year's End
Should Provisions and E-Surveillance Techniques be Reauthorized?
WHAT: The Internet Caucus Advisory Committee (ICAC) will host a luncheon panel, entitled "The Patriot Act & E-surveillance," on Thursday, June 30 at noon in the Capitol Building. The U.S. PATRIOT Act was passed with overwhelming bipartisan support in the weeks following the tragic events of 9/11. This piece of legislation expanded federal officials' existing surveillance and investigative powers for law enforcement and foreign intelligence investigations. Of over 150 provisions, 16 are set to "sunset", or expire, on December 31, 2005 unless reauthorized by Congress.
The ICAC will assemble a balanced panel of experts in electronic surveillance to discuss issues surrounding PATRIOT Act reauthorization. The panel will debate the issues that Congress must decide before adjournment this fall, including, but not limited to: Section 213. "Sneak and Peak" or "Delayed Notification Warrants;" Section 215. "Business Records" or "Library Records" Provision; Administrative Subpoena Powers Under Patriot Reauthorization Act (PAREA) (Recently Reported Out of the Senate Intelligence Committee); Sharing of Information Between Foreign Intelligence Agencies and Domestic Agencies (i.e. "The Wall"); and Section 206. Roving Wiretap Surveillance Authority Under FISA.
WHO: The fair and balanced panel will be moderated by Professor Peter Swire, Moritz College of Law of the Ohio State University, and will feature: William Moschella, Assistant Attorney General for Legislative Affairs, Department of Justice; Jim Dempsey, Executive Director, Center for Democracy & Technology; Emily Sheketoff, Associate Executive Director, American Library Association; and Patrick Rowan, Senior Counsel to the AAG, Department of Justice Criminal Division.
